DRIVER UNDER INFLUENCE OF ALCOHOL AND DRUGS TO BE ARRAIGNED FOR CRASHING INTO AND KILLING MOM WHO WAS RIDING BIKE WITH SON

WESTMINSTER – A driver under the influence of drugs and alcohol has been charged with killing a woman by crashing his car into her while she was riding her bike on the sidewalk with her son. Alex Trujillo, 43, Garden Grove, is charged with felonies for gross vehicular manslaughter while intoxicated, driving under the influence of alcohol and drugs causing bodily injury, and driving with a blood alcohol level of .08 percent or more causing injury. He has a prior conviction for driving under the influence in 2002. He faces a maximum sentence of 10 years in state prison if convicted. The People will be requesting $150,000 bail at Trujillo’s arraignment today, Tuesday, Oct. 21, 2008, at 1:30 p.m. at the West Justice Center in Westminster. The department is to be determined.

At approximately 4:55 p.m. on Oct. 12, 2008, 46-year-old Catherine Busse was riding her bike on Lampson Avenue in Seal Beach with her 15-year-old son, Samuel Busse. The pair was riding on the sidewalk. Trujillo, who was under the influence of prescription drugs and had a blood alcohol level of .13 percent, is accused of veering off the road and driving up onto the sidewalk at 45 mph. (Chaimfan: Really sounds like an accident, eh?) He is accused of crashing his car into Catherine Busse. The victim was thrown from her bike and landed nearby. Witnesses called 9-1-1 and detained Trujillo until police arrived. Catherine Busse died at the scene from blunt force trauma to the head. Her son, Samuel Busse, was transported the hospital to be treated for minor injuries.

Trujillo, who had a prior conviction for driving under the influence, had completed an alcohol awareness class and a Mothers Against Drunk Driving panel, during which he was advised of the dangers of driving under the influence of alcohol and drugs.

Deputy District Attorney Susan Price of Homicide Unit is prosecuting this case.

SEAL BEACH–More than 300 family members and friends are expected to attend services today for the woman who died after being hit while riding her bike with her autistic son.

A viewing will be held at 2 p.m. at All Souls Mortuary in Long Beach, followed by Mass at 7 p.m. at St. Anne's to remember Cathy Busse, 46, of Seal Beach.

Busse was described as a warrior mom, a term given to mothers of autistic children, who was feisty with a smart sense of humor. She worked as the vice president of Human Resources for American First Credit Union in La Habra and was active in Talk about Curing Autism, a volunteer group.

She also loved to exercise and always included her son, Sam, 14, in her physical fitness activities.

"She would do things to make sure Sam was being active," said her sister, Angi Biscan said. "They would play tennis basketball and they loved to ride bikes."

Busse was biking with Sam about 5 p.m. Oct. 12 on Lampson Avenue just east of Seal Beach Boulevard when a blue Ford truck struck them and then crashed into a eucalyptus tree.

Busse was taken to Long Beach Memorial Hospital and was taken off life support on Oct. 15 after doctors detected no brain activity, said her husband, Ben Busse.

"She was a wonderful woman," he said. "She was a good mother and a good advocate for her son."

Sam was treated for minor injuries and released.

The driver, Alex Trujillo, 43, of Garden Grove was arrested by Seal Beach police on Saturday. He pleaded not guilty in court on Tuesday to gross vehicular manslaughter while intoxicated, among other charges.

Trujillo was convicted in 2002 of driving under the influence. His blood alcohol level was .13 at the time of the accident, according to the Orange County District Attorney's Office.

Ben and Sam Busse visited the accident site on Saturday to leave flowers near the eucalyptus tree. Sam would not hold the bouquet but just stood still on the sidewalk – his gaze falling to the place where his mother had been, Biscan said.

"He was very distraught," she said.

His father took him home and Sam, who has limited verbal ability, immediately ran to Busse's bedroom and sprawled out across her bed, hugging the empty space.

"He can't tell us what he's thinking or what happened," Biscan said. "This is how he is showing us his emotion. He really misses her."

Busse is survived by her son, Sam, husband Ben, mother Geraldine, five sisters and numerous nieces and nephews.

Staff writers Niyaz Pirani and Larry Welborn contributed to this report.

Do I really need to tell you what would have happened if a white male had run down a Hispanic woman on a sidewalk at a high rate of speed? Actually, I don't. The Orange County courts and jury have already told us!

Two self-proclaimed white supremacists were convicted today of beating a man unconscious after he mentioned his ethnicity, officials said.

Nicholas Tyler Gibbs, 20, of Anaheim, and Ryan Joseph Swanson, 19, of Huntington Beach, were both sentenced to six years in state prison for their involvement in a hate attack against 24-year-old Ryan Honeycutt, according to the District Attorney's Office.

The two men pleaded guilty on felony counts of aggravated assault, unlawful taking of a vehicle and a misdemeanor count of battery with serious bodily injury. They were also charged with a sentencing enhancing for committing a hate crime together and causing great bodily injury.

On May 26, Honeycutt was having drinks at a bar in Seal Beach with a woman prosecutors identified as Amanda L. When they left, they found Honeycutt had a dead battery, and the woman called Swanson and Gibbs for help.

Gibbs and Swanson jump-started the car in the parking lot, and then all four went back to the woman's Seal Beach home after buying beer.

During a conversation, Honeycutt mentioned that he was half-Salvadoran, according to prosecutors. Swanson allegedly said, "You mean you're (expletive) El Salvadorian? You're basically a dirty (expletive) Mexican."

Swanson and Gibbs, who both have white supremacist tattoos, told Honeycutt that they were white supremacists. When Honeycutt began to leave, Swanson and Gibbs attacked him outside – punching him in the head, knocking him unconscious and stomping on him after he had fallen to the ground, prosecutors say.

Honeycutt suffered a broken collarbone, a concussion and cuts to his face. Swanson and Gibbs stole Honeycutt's car, keys, wallet and cell phone. After regaining consciousness, Honeycutt returned to the woman's house. She drove him home, where he called for help. His car was found three days later in a Long Beach parking lot.

CF,

I hope you are not stating that you think the Salvadoran victim deserved the hate which he witnessed. It sounds like the court did have evidence it was a hate-crime because the attackers stated that they hated Salvadorans and Mexicans. I am appalled at all the hatred which is being expressed these days.

I think that it is wrong that they let these illegal immigrants kill people without much responsibility. I believe , as you probrobly do, we should erect a strong border and prevent these leeches from entering the country in the first place. We also should enforce the laws which are meant to protect the AMERICAN CITIZEN against FOREIGN ALIENS. Our system seems completely backwards at this time... I pray that we can restore justice to this country.

You shall make yourself the Festival of Sukkoth for seven days, when you gather in [the produce] from your threshing floor and your vat.And you shall rejoice in your Festival-you, and your son, and your daughter, and your manservant, and your maidservant, and the Levite, and the stranger, and the orphan, and the widow, who are within your cities

Of course not!!! I am Mexican myself. But it is undeniable that the courts are vastly more likely to prosecute hate crimes that are committed against minorities than those against whites (which are the vast majority of hate crimes). Do you remember what happened when that black mob beat the three trick-or-treaters in Long Beach two years ago?

Both Trujillo and those skinhead kids should fry.
