GarciaJorge Garcia, 39, was charged New Year's Day with child neglect without great harm and resisting an officer without violence. He got out of the Volusia County Branch Jail after posting $6,500 bail, a booking officer said this morning.
Garcia was one of nearly 10 to 15 people involved in an argument at the corner of DeLeon and Matanzas roads in DeBary on Friday at 2:45 a.m., a sheriff's report said.
As deputies arrived at the scene, people were dispersing but a person asked deputies to check out a vehicle with Kentucky plates, reporting someone in the sport utility vehicle had a firearm, the report said.
According to the report, deputies made the stop at Lucerne Drive and Amigos Road, and that was when Garcia arrived on the scene and started cursing at deputies and acting in an irrational manner toward the officers. Garcia was given several verbal commands to get in his vehicle and leave but he refused. A sheriff's sergeant then ordered Garcia arrested.
Garcia then entered his vehicle and when deputies told him he was under arrest, he refused to get out of the vehicle. The sergeant then ordered deputies to fire a Taser stunning device at Garcia. That was when Garcia grabbed an infant sitting next to him and held the child in front of his body telling deputies numerous times, "Tase the baby," the report said.
Deputies managed to get the child unharmed from Garcia and two deputies then used their Tasers on him, the report said. Garcia then obeyed deputies commands and was placed under arrest, the report said.
Tangeca GarciaGarcia's wife, Tangeca, 35, was also arrested and charged with two counts of resisting an officer without violence, the report said. Tangeca Garcia interfered with deputies efforts to arrest her husband. She hugged her husband and got between deputies and her husband blocking deputies from firing their Tasers at him, the report said.
Tangeca Garcia was released from the Volusia County Branch Jail after posting $500 bail, a booking officer said.
