Attorney: ObamaCare 'on life support'

Two important appeals court cases involving ObamaCare are due to be argued this spring.

 

Liberty Counsel founder Mat Staver will argue one case, while Virginia Attorney General Kenneth Cuccinelli will handle the other. The former says both cases, which are scheduled for the week of May 10-13, target the federal mandate that a person purchase the insurance, but Liberty Counsel's case also deals with the employer mandates.

Matt Staver"I am very confident that the [Fourth U.S. Circuit] Court of Appeals -- or certainly at the last stage, the United States Supreme Court -- will strike this down as unconstitutional, because it clearly exceeds Congress' authority," Staver contends.

If Congress can pass laws like ObamaCare, the attorney says that means the country has lost many of its liberties, "because Congress could therefore intrude into private individual decisions and employer decisions -- something that the Constitution has never allowed Congress to do."


He expects an appeals court decision to be reached on his case this summer, which would send the case to the U.S. Supreme Court.

 

In a recent email to supporters, Staver describes ObamaCare as being "on life support," adding that he "wholeheartedly believe ObamaCare's demise is coming soon -- either in the legislature or in the courts."
