Attorney: Craigslist dodging liability

Craigslist logoCraigslist continues to run ads allegedly involving sexual trafficking, but the website is refusing to take responsibility for the activity.

 

The online bazaar claims it has "no liability whatsoever" for people who post pornography and prostitution advertisements or sexually-trafficked children on its website. But Pat Trueman, founder of PornHarms.com and director of The Coalition for the War on Illegal Pornography, argues otherwise. He notes that the Communications Decency Act is a specific law relied upon by company officials.

Pat Trueman"This was a law designed to protect children from Internet pornography or solicitations over the Internet," he explains. "That law was struck down except for the immunity provisions, which say that if a website doesn't post the material they're not responsible for it."

But Trueman points out that when operators of the website make room for adult services that are posted daily, there is some degree of responsibility. "That law that they rely on was designed to protect children, not to exploit them like Craigslist is doing," he contends.

The Coalition director believes Congress needs to take action to clarify the law so that websites cannot be used to aid and abet child exploitation. He concludes that "Congress should not continue to look the other way" and alleges that Craigslist is violating state laws as well.

Child porn and consensual prostitution between adults are two different things. They are both evil but there is an entire order of magnitude between them.
