Jetmir Xhelollari, 35, was sentenced to indefinite imprisonment for public protection at Harrow Crown Court in February, but judges at London’s Criminal Appeal Court this week ruled that the original judgment was “wrong in principle.”

     Xhelollari raped the 23-year-old by persuading her to come to his flat in Edgware after meeting her in a coffee shop in Hendon last August. He then forced her to go out to a restaurant and nightclub with him claiming he was in the mafia and would otherwise kill her.

The young tourist, who had only been in the country for a few weeks, was eventually able to escape after attracting the attention of another clubber, who helped her get a taxi.

Last Thursday, lawyers representing Xhelollari, a Kosovan illegally in London, argued that the imposition of the IPP sentence was “wrong in principle” - and the three judges agreed.

Mr Justice McCombe said: "It is conceded that every offence of rape is serious, but it does not follow that an indeterminate sentence should be imposed in every case - we agree. Having considered the arguments and the matters that influenced the trial judge, we consider the imposition of a sentence of IPP in this case was wrong in principle.

“The pre-sentence report did not identify factors that bring the conclusion that there is a significant risk of serious harm in the future. For these reasons, we quash the sentence of IPP and must go on to consider the appropriate determinate term.

“We acknowledge the aggravating factors. The victim was vulnerable, but not in the category of exceptional vulnerability. She was taken to his flat, but was tricked, rather than forcibly abducted.

“In all the circumstances, we consider that a sentence of eight years' imprisonment is the appropriate sentence of imprisonment in this case.”
The judges upheld a recommendation that Xhelollari be deported on his release.
