NEW YORK: U.S. immigration authorities acted constitutionally when they subjected dozens of people returning from an Islamic convention in Canada to screening tactics usually reserved for people suspected of being terrorists, an appeals court said Monday.
The court upheld the conclusion of a federal judge that the 2004 inspections, which involved frisking and fingerprinting, did not violate U.S. constitutional rights to practice religion and avoid unlawful searches.
"We do not believe the extra hassle of being fingerprinted and photographed — for the sole purpose of having their identities verified — is a significant additional burden that turns an otherwise constitutional policy into one that is unconstitutional," a three-judge panel wrote.
The New York Civil Liberties Union had sued on behalf of five New York residents who attended the "Reviving the Islamic Spirit" conference in Toronto. The NYCLU sought a court order to prevent similar inspections, along with destruction of personal information collected during the stops.
The residents were searched after telling border officers they had attended the Islamic conference. They were frisked, fingerprinted and photographed, and their cars were searched. They were required to fill out several forms and were questioned about their past travels, what occurred at the conference and why they attended it.

Each plaintiff was detained and searched for between four and six hours, after which he or she was released into the United States, the appeals court said.
The U.S. Bureau of Customs and Border Protection had received intelligence giving it reason to believe people with terrorist ties would be attending certain Islamic conferences during the 2004 year-end holiday season.
The court said the inspections were necessary because it was not possible for authorities to know who at the conference may have interacted and potentially exchanged identification or travel documents with people suspected of being terrorists.
NYCLU Executive Director Donna Lieberman said she was upset by the ruling.
"The decision's deeply disappointing because the court refused to vindicate the rights of innocent American citizens who were detained at the border and treated as terrorists simply because they attended a religious conference," she said.
The NYCLU had not decided whether to appeal, she said.
The government had no immediate comment, Department of Justice spokesman Dean Boyd said.
Cars full of muslims coming back from an islamic event....of course they should have been stopped and searched! Im glad that there were some non PC and non apologetic guards working that day!

And just look at the kind of scum they had speaking at that "confrence"
The Reverend Robert Schuller has quietly told self-styled “interfaith leader” William Baker to vacate his Crystal Cathedral office. The order came after an investigation published in OC Weekly revealed that Baker, who runs Christians and Muslims for Peace (CAMP), has a long history of anti-Semitic politics and held a leadership position in neo-Nazi organizations. The investigation also revealed that Baker had manufactured much of his alleged academic qualifications.
“We have separated ourselves from the CAMP ministry, and Mr. Baker will be off the campus as of May 31,” a Crystal Cathedral spokesman said.
Sources at Crystal Cathedral stated that the decision was based largely on revelations made in OC Weekly ("Hour of White Power,” Feb. 15). Soon after that story appeared, the Crystal Cathedral removed from the church’s website a link to Baker’s CAMP site, where Baker had peddled an anti-Semitic book titled Theft of a Nation.
Baker was chairman of the neo-Nazi Populist Party in 1984 and organized its national convention that year. The Populist Party was established and directed by Willis Carto, head of the now-defunct Liberty Lobby. The dean of American neo-Nazi politics, Carto also founded the Costa Mesa-based Institute for Historical Review, a group whose central purpose is Holocaust denial. In a written statement, Baker claimed he did not know the Populist Party was racist and that he never shared Carto’s racist politics.
and of course the "shock" of muslims about learning that they had invited a vile monster like baker to speak ::)
In reference to another speaker at the conference, Chanicka denied that organizers knowingly invited someone who is alleged to have ties with American groups that have a racist agenda.
“We have no business being involved in inviting anyone who shares any agenda of hate and racism, because we don’t find that to be anything within the realm of Islam or beliefs as Muslims, especially within the purpose of this conference, which is promoting a pluralistic Canadian society,” Chanicka said.
He was responding to allegations made by Bernie Farber, executive director of the Canadian Jewish Congress. Farber alleged that panelist William Baker, founder of Christians and Muslims For Peace, had been connected with American groups with a racist agenda.
Farber also suggested that “serious questions” had to be addressed to the organizers as to why they had invited “someone like Baker” to speak.
If by "pluralistic" they mean that they are all getting together to figure out how to create yet another 'glorious' sharia crapistan here in the west...then I believe that :P

Re: "...Cars full of muslims coming back from an islamic event..."
This, itself, is an act of Terror!
After being strip-searched, the vehicles in which they were traveling should have been confiscated by the government.
