Whales don't have constitutional rights, lol.

I do think that they need to be kept in more humane conditions though. Tillikum would never have killed anyone if he hadn't lived a life of stress in captivity. Of course he can't be released due to the fact he's been captive so long either, but animals that large need MUCH bigger tanks.
