Tony Eugene James, 22, of the 2900 block of Nelson Street, Fort Myers, and JaJuan Alle Smith, 23, of the 2100 Thomas Street, were each charged with disorderly conduct. James also was charged with battery.
According to Lee County Sheriff's Office reports:
Just after 8 p.m. Sunday, deputies went to Wendy's, 15300 McGregor Blvd., Fort Myers, about a fight between customers.
Daniel Ford, 56, whose address was not listed, had a nose bleed and bruise above his eye and Eric Miller, 31, was bleeding from the mouth. Witnesses told deputies Miller was intoxicated and had been eating inside the restaurant. Ford and other people were eating with their church group.
James and Smith were ordering food when Miller cut in front of James asking for some sauce, which made James angry. They argued, James and Smith hit Miller, and Miller fell to the floor after being kicked.
Ford intervened and James hit him in the face. James and Smith walked out of the restaurant, witnesses followed and Ford held the doors closed to keep the two from re-entering.
Deputies found them hiding behind a Dumpster and shed behind a gasoline station across the street.
James told deputies he had been drinking earlier and was mad because Miller disrespected him.
Ford, whose church name was not listed, wants to prosecute, but Miller declined.
One witness could not complete a statement because his wife, who saw the attack, became so stressed she had to go home immediately because of health concerns.
