Despite widespread criticism from the public and internal dissention, Massachusetts has voted to allow out-of-state homosexuals to "marry" in the state.

The House voted 119 to 36 to eliminate a 95-year-old law that bans out-of-state couples from "marrying" in Massachusetts if their union would be prohibited in their home states. Chapter 207, Section 11 of Massachusetts state law states:

No marriage shall be contracted in this commonwealth by a party residing and intending to continue to reside in another jurisdiction if such marriage would be void if contracted in such other jurisdiction, and every marriage contracted in this commonwealth in violation hereof shall be null and void.

The measure to repeal the 1913 law, S 800, passed the House Tuesday and was approved by the Senate on July 15. It will now make its way to the governor's desk.

Gov. Deval Patrick, a Democrat with a lesbian daughter, promised he would endorse it.
