BOISE - He was the first person in Idaho convicted of knowingly spreading the HIV-AIDS virus – now, more than a decade later Kerry Stephen Thomas, 45 is once again facing those same charges.

In the 1990s Thomas’ case was a landmark one which sent Thomas to prison for several years.

At the time, he was well-known as a former BSU basketball player. He then became notorious for intentionally having sexual relations without revealing he was infected with the HIV virus.

He was first accused of these crimes in 1990, but reached a plea agreement for the lesser charge of statutory rape, for which he served time and was released on parole.

In 1996 he was convicted of purposely transferring the AIDS virus.

He was sentenced to 15 years in prison -- 7 years fixed.

After serving his time, Thomas is once again out on parole -- and according to the Ada County Prosecutors has once again committed the same crime.

Thomas is listed as a registered sex offender with the State of Idaho.

If convicted on these latest charges, Thomas could face life in prison as a "persistent violator."

If you knowingly infect someone with AIDS, you should be quarantined at the very least.  There was a schwartze in WA state in 2004 who infected 17 women and they may have infected 160 other people.  It's not even illegal to give someone AIDS in Oregon.  You would think the gay lobby would care about something that could really kill them directly. Apprently they are only interested in their political agenda of gay marriage, rather than keeping the public safe.  I know the people getting AIDS sinned but they could change and when they have AIDS, it's a life sentence.
