To clarify, I'm referring to medical expenses not covered by insurance should be deducted from your final settlement before the attorney takes his percent. Also- triple check that all doctor visits, procedures/surgeries and all physical therapy rehab is covered by insurance.
I was in a law office last year, and a lady was sobbing because the attorney directed her to physical therapy rehab that wasn't covered by insurance and never told her. I heard her say she ran up $20,000 in uncovered rehab bills, and wanted the attorney to split the bill with her. (Which seemed fair to me).
He refused.
Also, some attorneys take as much as 2/3. You have a great case- it appears 100 percent the defendant's fault, so a 1/3 attorney's cut is all he or she should receive.
