SAY NO To UnConstitutional Income Tax.

I was sent this article of a man in New Hampshire that is not and will not pay income tax because it is both Unconstitutional and has no written legal area directing people to file.  Brian, the leader of the new Conservative political party called Loyalist Party sent the article this morning.  Enjoy: http://www.foxnews.com/story/0,2933,245003,00.html

Jan. 17: Ed Brown stands barricaded in the doorway of his home, saying he is prepared for an armed standoff in Plainfield, N.H.

The New Hampshire man who is holed up with armed supporters in his fortress-like house after being convicted of tax evasion says he just wants everyone to pay attention and obey the law.

"I want people to realize that there is no such thing as an obligation to pay income tax," said Edward Brown. "It has nothing to do with the Constitution."

A jury ruled Thursday that Brown and his wife, Elaine, plotted to hide their income and avoid taxes on Elaine Brown's income of $1.9 million between 1996 and 2003. Over 10 years, they also used $215,890 of postal money orders broken into increments just below the reporting threshold to pay for their hilltop compound and for Elaine Brown's dental offices.

After the pair were convicted Thursday on 17 felony counts, Brown and a group of supporters sequestered themselves in his home in Plainfield, N.H.

They say there is no law stating that they must pay tax on Elaine Brown's income. "We told them, 'Show us the law and we'll pay immediately,'" Edward Brown said in an interview Friday.

'Live Free or Die' Brown said the tax-evasion charges were retaliation for a suit he filed against Judge Steven McAuliffe, Assistant U.S. Attorney William Morse and others after authorities raided his wife's dental practice last year.

"They had snipers with state troopers, they had 20 armed officers," said Brown. "What did they need all of them for? Just to download a computer? "They've ruined my life. My wife is a basket case."

On Thursday, Morse ordered Elaine Brown not to join her husband at their home as a condition of her release until sentencing. She is now living in Worcester, Mass., with her son. The couple has been married since 1985.

"Some people are drawn to the anti-tax movements and the false representation that there is no legal requirement to file and pay taxes. Today's verdict clearly reaffirms the repeated rejection of these arguments in the courts," IRS Special Agent Douglas Bricker said in a statement after Thursday's court ruling.

When asked how many people were with him, Brown declined to cite a number and replied he was with friends and family.

But he added that authorities cannot risk removing him forcibly because "there are so many people involved. I have little old grandmothers staying with me."

Brown described his property as "self-contained" with generators, food, water, and Internet access. He said that supporters are not fearful of coming or going from the premises.

He said Gary DiMartino, a negotiator for the U.S. Marshals, "has been a gentleman," and that neither he nor his supporters have been abused or threatened.

"DiMartino has been honorable and is a negotiator," Brown added. "He's just rather confused after 25 years of brainwashing," he said, referring to the legality of income taxes.

"I told him [DiMartino] you got to do your job. ..."I have been around police all my life. They're my brothers."

Brown said he feels it's his obligation to protect and defend the Constitution by resisting unjust laws.

"We do this for our nation," he said. "I'm a man of honor. I can never lie, cheat, or steal, ever."

Earlier, Brown was quoted by the Associated Press as saying he expected federal agents to swarm his property soon.

"Live free or die," he said, quoting New Hampshire's Revolutionary War hero Gen. John Stark and the state's motto. "What else can I say?"

Bernie Bastian, a Brown supporter who said he was carrying two guns, said he and about two-dozen supporters would stand with their friend.

"He's here at the house, and he's not leaving of his own free will," Bastian said.

Actually you forgot to mention how he was arrested

United States Marshal Stephen Monier stated: "The Browns may now begin serving their 63-month federal prison terms [ . . . ] High profile situations like this are always difficult, but they don't have to be tragic. I'm glad no one was injured, and that the community remained safe throughout the operation."[47]

The Browns were arrested by undercover officers, who were invited by the Browns into the Brown residence on the evening of Thursday, October 4, 2007. "efore the couple realized they weren't supporters, they were already under arrest."[48] A local television station quoted U.S. Marshal Monier as saying: "Ultimately, this open-door policy that they [the Browns] seemed to have which allowed the Browns to have some supporters bring them supplies, welcome followers and even host a picnic --this proved to be their undoing [ . . . ] They invited us in. We escorted them out."[49]

After the arrests, law enforcement personnel began searching the home and found weapons, ammunition, explosive devices and booby traps.[50] At a news conference on October 5, 2007, U.S. Marshal Monier said that even more charges against the imprisoned Edward and Elaine Brown are now likely: "By their continuing actions, allegedly, to obstruct justice, to encourage others to assist them to obstruct justice, by making threats toward law enforcement and other governmental officials, they have turned this into more than a tax case."[51]

In prison, Ed Brown claims that he has been mistreated, tasered, gassed, subjected to sensory deprivation, and isolated from other inmates.[52] In a recorded telephone call between Ed Brown in prison and a Brown supporter named Shaun Kranish, Brown and Kranish revealed that Kranish had previously introduced Brown to a man known as "Dutch" who thereby infiltrated Brown's circle of acquaintances, and that Dutch turned out to be a deputy United States Marshal who was among the group of deputies arresting Ed and Elaine Brown on October 4, 2007, ending the standoff.[52]

Actually you forgot to mention how he was arrested

I didn't forget, I chose not to :). I watched the Marshal's press conference, I know how they did it. That isn't the point. The point is the government can arrest you if they want to.

there is no law, but the government will find a way to get your money......

I don't understand how some people have had charges dropped against them and no longer have to pay taxes while others get charged when they bring up there is no law saying one has to pay taxes on their income?

Cohen, this is because those people have had the gumption or testicles to actaully take it to court and state their case in front of a Judge and Jury.  The fact is that Income Tax is not only unconstitutional, a violation therein and has no written obligation stating that the people must file income tax forms. 

I wish you all luck and give it a try.  Canada it was illegal until recently when they actually legislated its legality, I believe.  Previously, we had a War Income Measure Act. that was passed in 1914, I believe, to pay a certain percentage to fund the war.  It was supposed to be eliminated but the powers that be kept it in place to pay for WW2.  Even more tragically, it has continued....

Amendment XVI

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration.
The collection of Income Tax has been over ruled by the Supreme Court on various occasion as a taxation on the fruit of ones labor and not considered "profit".  Profit is taxable but if you perform a service to or work for an hourly wage, that wage is not "profit" but the exchange of services and is considered an extension of you, the individual. 

My friend works for the IRS and he too says Income Tax is Unconstitutional and the only reason he pays is because he works for them......at a good salary ;)

To my knowledge, there is nothing whatsoever within the Constitution that dictates every citizen of the United States of America must fill out and submit a tax return...  ;-)

Thanks for explaining it.

But Amendment XVI doesn't mention profit, it says income, from whatever source derived, that would mean through trade, exchange of labor, or whatever you call it.

I would def want to see income tax abolished.

Here's one more very important reason:

The Constitution says it is a G-d-given right to not have to testify against yourself...The Fifth Amendment.

By filing your taxes with the IRS, you have to give up that Fifth Amendment Right when you sign the form.

The IRS claims it is "the most succesful voluntary income tax system anywhere in the world".

They claim it is "voluntary".

But failure to file and/or evasion of what is "voluntary" results in Federal prosecution and imprisonment for felony charges.

When the IRS is asked "How can I be arrested for choosing not to file if you claim it is "voluntary", the official answer they give is the following load of pure b_llsh_t:

"Voluntary means that all citizens volunteer to file their own tax returns and pay what is due".

Another reason for you to ponder:
Immediately after the Sixteenth Amendment was forced on the public in spite of the fact that it was never properly ratified, The United States Supreme Court struck it down six continuous times in six separate cases on the grounds that it is unconstitutional to tax one's labor!  Regardless of their decisions, the Federal Government chose to disregard the Constitution and threaten at gunpoint any citizens who refused to "volunteer".

Research it yourself and find out if what I have written is true.

Yeah, but meanwhile everyone pays their taxes without question and any politician who seriously talks about even tax reform, let alone elimination, never gets anyware.  I still maintain that if people got 100% of their salary and had to write a check to the government once a year to pay their taxes, you'd see a lot more tax protesters.

Ok, sorry to have replied to so many of your posts in the last minute or so...

I agree with you partly. However I do agree with cigarettes and alcohol being significantly taxed, thereby making money for the government and acting as a good deterrent without pushing alcohol and cigarettes underground.

I agree with you partly. However I do agree with cigarettes and alcohol being significantly taxed, thereby making money for the government and acting as a good deterrent without pushing alcohol and cigarettes underground.
I'd actually go for banning cigarrettes, as for alcohol, forget taxing it, if we want to limit people's consumption, we need to give the people who live to get drunk better things to do.

My reasoning for the use of income tax and no other tax is quite simple, the government needs money to do anything, so there has to be some tax, the fairest way to do things is to take a percentage of whatever everyone earns, it means people who are saving their money give us much to the state as those who spend and spend and spend. And, in my opinion, multiple types of tax makes the whole idea rediculous, the same initial lump of earnings should not be taxed more than once, one flat rate tax should be all we have, it would make the system fair and simple.

Banning cigarettes would do nothing, just make it illegal and therefore push it underground. This would lead to it being less safe. As such, having tax on legal cigarettes is a really good idea.
