I don't think he should be helping to make it easier for people to smoke.

Actually he writes that it is forbidden to smoke. This is all marketing and non-sense for a quick buck by those companies.

The issue of smoking being prohibited is due to health reasons. Smoking on Passover (intermediate days) is just as bad as smoking during the year. There is no chametz in it and never has been.

Actually on all days except Shabbat one can smoke (including on Yom Tov) its just one has to know how it is to be done (from existing fire to light this fire and when done cannot extinguish it, it should extinguish by itself. You can just leave it on the tray or floor or something else).

In short (check the link for the full question and answer)

first of all, smoking is not achila (eating). Second of all, it is not even raui l'achilas kelev (edible for a dog). Third of all, even if it was, you can have hanaah (benefit) from chametz that is just not raui l'achilas adam (edible for a human), which we all will agree that it isn't. Fourth of all, where is there a specific 'additional prohibition of getting benefit from chametz on Pesach from smoking'.

You are not supposed to have any Chametz in your possession in your house. This is why we clean in order to remove all Chametz in our living spaces.

Quote
The Torah has several commandments governing chametz during Passover:

* The positive commandment to remove all chametz from one's home (Exodus 12:15).[1]:§9

* Not to possess chametz in one's domain. (Exodus 12:19, Deuteronomy 16:4).[1]:§11, 20

* Not to eat chametz, or mixtures containing chametz (Exodus 13:3, Exodus 12:20, Deuteronomy 16:3).[1]:§12, 19

The prohibitions take effect around late morning on the eve of Passover, or the 14th of the month of Nisan in the Jewish calendar. Chametz is permitted again from nightfall after the final day of Passover. Traditional Jewish homes spend the days leading up to Passover cleaning and removing all traces of chametz from the house.

See Shemot 12:19

19. For seven days, leavening shall not be found in your houses, for whoever eats leavening that soul shall be cut off from the community of Israel, both among the strangers and the native born of the land.

And Devarim 16:4

4. And no leaven shall be seen with you within all your border for seven days; neither shall any of the flesh you slaughter on the preceding day in the afternoon, remain all night until the morning.
You shall make yourself the Festival of Sukkoth for seven days, when you gather in [the produce] from your threshing floor and your vat.And you shall rejoice in your Festival-you, and your son, and your daughter, and your manservant, and your maidservant, and the Levite, and the stranger, and the orphan, and the widow, who are within your cities

The issue is that if there was Chametz in cigarettes a Jew would not be able to own them and possess them within his home...

I don't think people regularly eat their cigarettes... The issue has to do with owning chametz...

Its talking about owning real Hamess. If their is any ingredient that could possible be from wheat (or the grains) it is definitely battel (nullified) from before Pessah starts and it is not edible at all.
This being the case do you throw away your mouth wash as well?

Although according to previous posts cigarettes do not normally contain Chametz, therefore this is only an advertising gimmick.

But what if someone wants to buy a pack of cigarettes after the Chag starts? If cigarettes were considered chametz one would not be able to purchase them at that time...

I throw away or sell all the chametz I can before Pesach, then I go to my Rabbi and nullify any chametz which remains..

Chabad has a helpful wizard which helps one determine what is chametz..

Tag,

I am not clear on what you are suggesting. I suspect it is either of these two ideas:

1) That if there were chametz in cigarettes it would be less than 1/60th of the combination and thus it would be nullified?

2) That burning it is a form of nullifying it?

Quote
http://en.wikipedia.org/wiki/Chametz

The Torah specifies the punishment of karet (spiritual excision) for eating chametz, one of the highest levels of punishment in Jewish tradition. During Passover eating chametz is prohibited no matter how small a proportion it is in a mixture, although the usual rule is that if less than 1/60 of a mixture is not kosher the mixture is permitted. If the dilution happened before Pesach then the usual 1/60 rule applies; however Ashkenazi Jews apply this leniency only if the mixture is liquid.[7]

Also, hana'ah (any benefit, such as selling) from some forms of non-kosher food is permitted, but no form of benefit may be derived from chametz during Passover. Mixtures containing less than 50% chametz, and which are not eaten by normal people (e.g. medicine or pet food, even if it is perfectly edible), may be owned and used on Passover, but may not be eaten.[8]

"But what if someone wants to buy a pack of cigarettes after the Chag starts? If cigarettes were considered chametz one would not be able to purchase them at that time..."

Forget cigaretts as this is probably even much less of an issue if at all. Take something like real food. If it was made before Pessah then it was Battel before Pessah. Soo going into the Hag it was battel therefor not Hamess. Their is only an issue for something made during Pessah. If you know it was made during Pessah even very very little will not Battel it.

Here an example (see link for full post)

http://kitniyot.blogspot.com/2013/03/good-news-for-chocolate-lovers.html

Chocolate and candy labeled “Kosher for Pesach only for those who eat kitniyot"  are technically permissible even for those who do not eat kitniyot, because the kitniyot in these products are added before Pesach and are batel be-rov. In addition, these products generally contain kitniyot oils, which, according to several leading poskim, are not included in the custom to prohibit kitniyot.

He goes on to write that kosher certification agencies label them as "Kosher for Pesach for kitniyot eaters" because "people are stringent".

I disagree and believe that this is really due to the Charedization of the kashrut organizations--and it seems that the Tzohar Rabbinical organization agrees with me. Last year, Tzohar started a campaign for more accurate "Kosher for Pesach" labeling. (See "Vered HaGalil and the Kitniyot Problem".)

It doesn't bother me that they are advertisng cigarettes as that is free enterprise, what bothers me is that they are advertsing as kosher l'pesach with a hechsher to boot.
This is as bad as the Eida HaChareidis putting hechsherim for pesach on tissues & toilet paper & the Hisachdus Harabbanim in America putting hecsherim for pesach on paper platers & plastic forks.
These things do not need a hechsher at all as there is absolutely nothing chometz in them.
I guess it is just another way to bilk the public for more money.

Actually on all days except Shabbat one can smoke (including on Yom Tov) its just one has to know how it is to be done (from existing fire to light this fire and when done cannot extinguish it, it should extinguish by itself. You can just leave it on the tray or floor or something else).
Not anymore. It used to be allowed when everybody smoked. Now that most people don't smoke, it is asur.

At least according to this:

Is it permissible to smoke a cigarette on Yom Tov?

Chacham Ovadia Yosef addresses this question in the subsequent passage in Halichot Olam, noting that physicians have determined that smoking poses danger to one's health, and one should therefore avoid smoking. The question he addresses concerns someone who had grown accustomed to smoking and has been unable to stop this habit.

Chacham Ovadia rules (listed to audio for precise citation) that a regular smoker who would experience discomfort by refraining from smoking on Yom Tov may smoke on Yom Tov. However, one who does not smoke regularly, and wishes to smoke for enjoyment, rather than to alleviate discomfort, may not smoke on Yom Tov. It should be noted that even when smoking is permissible on Yom Tov, one must light the cigarette from an existing flame, as kindling a flame is forbidden on Yom Tov. Furthermore, he may not extinguish the fire after smoking; he must let the cigarette go out by itself.
