ZAGREB, August 14, 2019 - The Jutarnji List daily on Wednesday ran an article on a decision of the High Magistrate Court to fine a local singer, Mario Roso, for uttering the salute "For the homeland ready" while singing the song of Marko Perković Thompson "Bojna Čavoglave" during a celebration of the Operation Storm's anniversary in the town of Makarska.

The daily newspaper says that it has obtained a copy of the June 13 final ruling of the High Magistrate Court which reads that the above-mentioned salute had been used as the official salute of the 1941-1945 Ustasha movement that was based on racism and therefore symbolises hatred to people on the basis of their race, religion and ethnicity.

According to the daily, the court dismisses the defence's claims that the salute sung by singer Roso was identical to the form used in the original text of the song "Bojna Čavoglave" and it holds that the defendant should have been aware of possible negative effects of chanting that salute. The court also holds that the defendant "should have refrained from such behaviour".

The court says in its ruling that chanting that salute in this case was therefore in contravention of Article 39 of Croatia's Constitution that reads that "any call for or incitement to war or use of violence, to national, racial or religious hatred, or any form of intolerance shall be prohibited and punishable by law."

The fact that the mentioned salute was a part of a song that is considered an artistic creation does not alter the fact that the salute also symbolises hatred for other people due to their religious and ethnic background, the explanation says.

The court holds that chanting that salute "creates a latent danger, unease and anxiety among persons who do not belong to a majority ethnic or religious or group".

Roso was fined 765 kuna plus court costs of 200 kuna, the daily reported.

I disagree with the fine. Whatever symbolism the phrase "For the homeland ready" has does not change its simple meaning. It does not mean kill Jews and Serbs. The fine shows there is no free speech.

Many people in Croatia use that salute as a neutral patriotic expression. I used it at some public events, and I am not an ustasha. Hating ustashas is one thing. Imprisoning people for saying words is quite different.

If people in Croatia use that as neutral patriotic expression thats fine. But couldn't the Croats invent something that is not connected to Nazism? This expression was basically hh for ustashas. And we know that Germans and Austrians punish harshly for using hh.

In Croatian folk etymology, the name of the city has been derived from either the verb za-grab-, meaning "to scoop" or "to dig". One folk legend illustrating this derivation ties the name to a drought of the early 14th century, during which Augustin Kažotić (c. 1260–1323) is said to have dug a well which miraculously produced water. In another legend, a city governor is thirsty and orders a girl named Manda to "scoop" water from Manduševac well (nowadays a fountain in Ban Jelačić Square), using the imperative: zagrabi, Mando! It seems that an early version of the expression comes from the 1866 song "U boj, u boj." There were no Nazis then. Here is the full text:

U boj, u boj!
Mač iz toka, braćo,
nek dušman zna kako mremo mi!

rik njihov ori,
bijesan je njihov jar!

Germany and Austria also punish people who criticize Islam. I think free speech is important. If the government imprisons people with some controversial opinions, they will imprison people with any controversial opinion.

This song looks fine. It is patriotic. If you think that salute you use today comes from this song it is fine. I know that you are good human being that would never misuse something like this.  :)

Still the salute remains contoversial for me because it was used in dark times.
